NextRound provides an AI-powered interview platform that enables employers to conduct automated interviews and allows job seekers to practice interview skills. The Service includes but is not limited to:

• Analytics and reporting features
• Related support and maintenance services

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to:

5. Payment Terms

5.1 Subscription Fees

5.2 Billing and Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method for all applicable fees. Fees are non-refundable except as required by law or as explicitly stated in our refund policy.

5.3 California Automatic Renewal Law

In compliance with California's Automatic Renewal Law, we will clearly disclose the automatic renewal terms, provide you with an easy cancellation method, and send you a reminder before charging your payment method for renewal.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by NextRound and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any portion of the Service without our express written permission.

7. User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing and improving the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless NextRound and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California. You waive any right to a jury trial.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
